Terminating Old Stalking Orders – Permanent SPOs aren’t so permanent after all
Arnold Law Office: The premier Oregon law firm for statewide stalking defense
The Oregon legislature did not provide for a mechanism to terminate a stalking order that was no longer needed. The Court of Appeals held that a termination is possible in the case of Edwards v. Biehler. Arnold Law Office pioneered the filing of motions to terminate in Lane County, having filed the first motion following the Edwards v. Biehler decision.
Typically if the order is no longer necessary because enough time has gone by, petitioners will agree to terminate the order (so long as the respondent agrees to a civil no contact agreement).
Attorney Mike Arnold estimates that a majority of all stalking orders are either frivolous or clearly do not meet the statutory definition of stalking. Go sit in the the Lane County courthouse on Monday mornings and hear how many of these cases are clearly aimed at gaining an advantage in a custody case, revenge for a break-up, involve a neighbor dispute, or are based on annoying behavior that clearly is protected speech.
At Arnold Law Office we understand the collateral damage that a stalking order can cause.
